Terms of Use

These Terms of Use govern your access to and use of the website at kovuna.com (the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

Important. Kovuna is a planned children’s long-term savings product that is intended to be offered through eNL Mutual Bank. The product is not yet operational. This Website is informational only. Nothing on it is an offer, a contract, a financial product, or an invitation to open an account, and using it does not create any banking or savings relationship. Any actual account will be governed by separate product terms issued by eNL Mutual Bank before you open it.

1.Who we are

In these Terms, “we”, “us”, “our” and “Kovuna” refer to the operator of this Website. “You” means the person accessing the Website. You may contact us at hello@kovuna.com.

2.Pre-launch, informational only

The Website describes a product that is in development. Content may be incomplete, may change, and may be removed at any time without notice. We make no commitment that the product will launch, that any feature described will be offered, or that it will be offered on the terms described here.

3.Not financial, legal or tax advice

All content on the Website is general information only. It is not financial, investment, legal, accounting or tax advice, and it does not take your personal circumstances into account. You should obtain your own independent advice before making any financial decision. We are not your financial adviser.

4.Illustrative figures and projections

Any amounts, growth rates, calculators, projections or examples shown on the Website are illustrative only. They are not a quote, promise, forecast or guarantee. Actual outcomes depend on the contributions made and the applicable rates, fees, taxes and other factors, and are not guaranteed. Past or projected performance is not a reliable indicator of future results.

5.The bank relationship

Where the Website refers to funds being “held by the bank”, or to licensing, regulation or deposit-holding, this refers to eNL Mutual Bank and its own products, terms and regulatory status. We do not ourselves hold deposits or provide banking services. Any banking product, account, interest, protection or guarantee is provided by and subject to the terms and regulatory framework of eNL Mutual Bank, not these Terms.

6.Waitlist and enquiries

If you submit your email address or other details to join a waitlist or make an enquiry, you do so voluntarily. Joining a waitlist is not an application for, or a guarantee of, any account or product, and creates no obligation on either of us. We may contact you about the launch. You can ask us to remove your details at any time by emailing hello@kovuna.com. Your information is handled as described in our Privacy Policy.

7.Acceptable use

You agree not to: use the Website for any unlawful purpose; attempt to gain unauthorised access to, interfere with, or disrupt the Website or its infrastructure; introduce malicious code; scrape, harvest or systematically extract data except as permitted by law; misrepresent your identity; or infringe our or any third party’s rights. We may suspend or restrict access if we reasonably believe these Terms have been breached.

8.Intellectual property

All content on the Website, including text, graphics, logos, the “Kovuna” name and mark, designs, images and code, is owned by us or our licensors and is protected by intellectual-property laws. You may view the Website for your own personal, non-commercial use. You may not copy, reproduce, modify, distribute, or create derivative works from any part of it without our prior written permission. The “eNL Mutual Bank” name and marks belong to eNL Mutual Bank and are used with reference to that institution.

9.Third-party links

The Website may link to third-party websites (for example, eNL Mutual Bank). We do not control and are not responsible for the content, products, or privacy practices of those websites. Links are provided for convenience only and are not an endorsement.

10.No warranties

The Website is provided “as is” and “as available”. To the maximum extent permitted by law, we give no warranties or representations of any kind, express or implied, including as to accuracy, completeness, currency, reliability, fitness for a particular purpose, uninterrupted availability, or freedom from errors or harmful components.

11.Limitation of liability

To the maximum extent permitted by law, we and our directors, employees, partners and suppliers will not be liable for any indirect, incidental, special, consequential or punitive loss, or any loss of profit, savings, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Website or reliance on its content, whether based in contract, delict, or otherwise, even if we were advised of the possibility of such loss.

To the extent we are found liable despite the above, our total aggregate liability arising from or relating to the Website is limited to ZAR 1,000.

Your statutory rights. Nothing in these Terms excludes, restricts or limits any liability or right that may not lawfully be excluded, restricted or limited, including under the Consumer Protection Act 68 of 2008. In particular, we do not exclude liability for death or personal injury, or for loss caused by our gross negligence, where the law does not allow such exclusion. Where any provision of this section is found unenforceable, it applies to the maximum extent the law allows.

12.Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability or expense (including reasonable legal costs) arising from your breach of these Terms or your unlawful or unauthorised use of the Website, to the extent permitted by law.

13.Privacy

Our handling of personal information is described in our Privacy Policy and POPIA Notice, which form part of these Terms.

14.Changes to these Terms

We may update these Terms at any time by posting the revised version on the Website. The “Effective date” above shows when they last changed. Your continued use of the Website after a change means you accept the updated Terms.

15.General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce a right is not a waiver of it. These Terms are the entire agreement between you and us regarding your use of the Website and supersede any prior understanding on that subject. You may not cede or assign your rights under these Terms; we may do so.

16.Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising from them.
